Topic: Criminal law essay

Description

“Some critics say that it is a disgrace that the mens rea of murder has never been reduced to statutory form. In fact, the arguments for doing so are weak because the elements making up the mens rea are not in any doubt: the cases provide a consistent and stable frame of reference.

The vexed question of how to deal with so-called ‘oblique intent’ in particular has been satisfactorily settled with a helpful rule of evidence.

The real benefit of a statute would be that it could incorporate much-needed reforms to that definition, but sadly there seems no appetite for any such change.”
Discuss. What changes to the mens rea of murder, if any, would you support?
